General Information, Terms, Conditions & Disclosures
TO OUR CUSTOMERS TERMS AND CONDITIONS UNDER WHICH
THIS ORDER IS ACCEPTED
SOCIAL POLICY
We understand that our business is not about providing
products. Our business is to promote companies, their
products, and further their objectives. With that mission,
we have made a conscious choice not to participate in
opportunities that we feel promote negative social consequences.
We respectfully decline those orders that contain or
promote obscene or pornographic content, violence, and
racism as well as promote use of illegal drugs, alcohol
or tobacco.
No verbal agreements recognized.
We reserve the right to reject orders which for any
reason are not acceptable to us.
This order will be executed only after acceptance by
an official of Kaeser and Blair. Notice is hereby given
to purchaser and the ultimate consumer of this merchandise
that he and /or they retain sole title and liability
for payment of such Federal, State and local taxes as
may be in order, lawful and applicable in those States,
Counties, Cities, Town, and Territories wherein these
goods are used and stored.
Because of the personal nature
of imprinted products, the customer understands that
Kaeser and Blair has a NO REFUND policy. All
claims for adjustment or other complaints must be made
within 10 days of receipt of goods. Accompany such complaints
with an actual sample taken from the shipment and copy
of this order. Your copy of the order will be returned
promptly with our reply. Do not return unsatisfactory
merchandise unless you have receive written instructions
from us.
"The customer shall indemnify and hold harmless the
printer from any decree of judgment finally sustained
against the printer, based upon any and all manner of
claims, demands, actions and proceedings that may be
asserted or instituted against the printer on the grounds
that the said printing violates any copyright or any
proprietary right of any person, or that it contains
any matter that is libelous or scandalous, or invades
any person's right to privacy or other personal rights;
and the customer agrees promptly, at the customer's
own expense, to defend and continue the defense of any
such claim, demand, action or proceeding that may be
brought against the printer, provided that the printer
shall promptly notify the customer with respect thereto,
and provided further that the printer shall give to
the customer such reasonable time as the exigencies
of the situation may permit in which to undertake and
continue the defense thereof."
This order is not subject to cancellation or change
after acceptance in our office. Should a cancellation
or change be received after the order has been accepted
it is understood that you will reimburse us for all
work performed to the full extent of the balance shown
on the face of this order. All changes will be made
subject to our ability to do so.
We are not responsible for delays in transit, consequently
we cannot guarantee delivery dates. If merchandise is
wanted for a special occasion, specify definite date,
allow ample time for manufacture and transit.
Prices are subject to change without notice, subject
to any terms or regulations imposed by Acts of Congress,
other Federal and/or State regulations or imposts, advances
in labor, raw materials, or to any other conditions
or circumstances beyond our control.
It is understood that the title to any goods shipped
pursuant to this order passes to the purchaser upon
our delivery to the carrier.
OUR TERMS: Our open account terms are NET 30.
All invoices beyond 30 days are considered past due
and will incur interest at a rate of 18% per annum beginning
on day 31. The purchaser on demand, agrees to pay all
costs and reasonable attorney fees which Set In Stone
may incur in the enforcement of this contract.
ARTWORK
All suppliers require clean, sharp black and white artwork
for reproduction of custom logos, unless specifically
noted. Artwork should be color separated for multicolor
imprints. Letterheads, yellow page advertisement or
photo copies are not generally acceptable to provide
acceptable printing results. Artwork can be sent by
e-mail. Ask for our instruction sheet to insure an accurate
and successful conveyance. If the customer cannot supply
camera ready art, K&B In-house Art Department will
prepare most logos from customer's copy for a flat charge
of $30.00 per logo net for one color or $45.00 per logo
net for 2-color artwork. Complex art is subject to quote.
CUTS, SCREENS, DIES & SETUP CHARGES
Depending upon the productions method, the item
and the price structure charges for setup may apply.
Consult the specific Best Buys page for the specific
product for these charges. Generally, manufacturers
maintain files for a maximum of 24 months. Reorders
placed after the 24 month period will require a new
setup charge.
PRODUCT COLORS
Color samples shown are to be used as a guide only.
Due to variances in the photographic, printing process,
and computer monitors, slight differences in the product
color may occur. If a product is to be used for a particular
"color" coordinated promotion and product
color is a significant part of the promotion, we ask
that you order a random sample or a product proof prior
to production.
IMPRINT COLORS
Standard imprint colors vary from item to item and
manufacturer to manufacturer. If a specific PMS color
match is required, contact Set In Stone for pricing
for the specific product as each manufacturer will have
their own pricing policy.
FUTURE DELIVERIES
Generally, manufacturers and K&B can accommodate
orders calling for delivery at some future date. However,
at these deeply discounted prices all orders must be
completed and shipped no later than December 31, 2006.
Shipment cannot be scheduled into 2007 at these prices.
MULTI-COLORS OR MULTI-LOCATION PRINTING
Unless specifically quoted on the product page in
our catalog, all pricing includes single color only
printed in a single location. For items not listing
multicolor or multi-location printing as an option,
Contact Set In Stone for pricing.
PRICING DISCLAIMER
All offers published at this web site constitute
the proprietary promotional implementation of Kaeser
& Blair Incorporated and do not necessarily reflect
or imply endorsement or participation of the original
manufacturer. All prices at this site expire unequivocally
and irrevocably at midnight December 31, 2004.
PRODUCTION TIME
All production times listed are "approximate"
and cannot be guaranteed due to variations depending
on seasonal changes. Times quoted are actual "working
days" (Monday through Friday, excluding holidays).
Please allow additional time for orders to reach K&B,
plus 1-3 days for K&B Processing, time for orders
to reach the factory and 3-5 days for delivery by UPS
ground. For "Special Event Dated" orders,
see paragraph below.
PROOFS
Paper proofs of the proposed imprint copy can be provided
on each item upon request. Product proofs may also be
available on certain items, consult with Set In Stone
for costs on both.
SAMPLES
Random imprinted samples are available on any product
shown at this site at 50% of the smallest quantity list
price shown. Sample purchases must be prepaid with the
exception of Mastercard, Visa, or American Express transactions.
All samples shipped prepaid by UPS ground. If expedited
service is needed appropriate charges will apply.
SPECIAL "EVENT" DATED ORDERS
Do not "assume" that a specific date can be
met if the item ordered is for a special event and would
be worthless if delivered after that date. Each case
must be specially authorized by Set In Stone. Once authorization
has been pre-approved, be certain to expedite your order
by overnight delivery to K&B and put the required
"in hands delivery by or cancel date" in the
appropriate box on the order form.
SUBSTITUTIONS
At time, K&B and our manufacturers find it necessary
to make substitutions. We reserve the right to provide
like product of equal or greater value without notice.
Note: This is especially prevalent on caps advertised
as "imports" - we do not advertise or guarantee
a specific import brand. This may vary from order to
order depending upon availability. On wearables it is
not uncommon to find variations between "dye lots"
and colors may also vary from order to order.
UNDER-RUN OR OVERRUNS
Due to the very nature of automated high-speed production
equipment and methods it is not possible to guarantee
exact quantities. It is industry standard practice to
allow for an under or over run of 5% on certain items.
Some items even run as much as 30% over run in higher
quantities. Invoices will reflect the actual quantity
shipped.
